Plaintiff sentenced to 3 months in prison for filing false caseOrder to pay compensation of Tk 50,000

Md. Sanaullah Riyad, Barguna : : A court has sentenced a plaintiff to three months in prison for filing a false, baseless and harassing case in Barguna and ordered to pay Tk 50,000 in compensation to the acquitted accused.

Judge Md. Iqbal Masud of the Barguna Chief Judicial Magistrate Court gave the verdict on Wednesday (July 29) afternoon. The court’s administrative officer in charge, Akhtar Hossain, confirmed the matter.

The convicted person is Mosharraf Hossain alias Harun Or Rashid. He is the son of Sekandar Ali of Chonbunia village in Bukabunia union of Bamna upazila of Barguna. The acquitted accused in the case, AKM Shahidul Islam, is a resident of Salna Bazar area of ​​Gazipur City Corporation.

According to court sources, on December 12, 2022, Mosharraf Hossain filed a case against AKM Shahidul Islam in the Bamna Senior Judicial Magistrate Court on charges of fraud. In the complaint, he said that Shahidul Islam took 15 lakh taka on the pretext of sending his son to Canada, but did not send it abroad and embezzled the money.
After a long judicial process, the accused AKM Shahidul Islam was acquitted as no acceptable evidence was presented in the court. At the same time, the court opined that the case was baseless and harassing.

Later, on July 20, the court ordered the plaintiff to appear in person and show cause. However, he did not appear in court on the appointed day and went into hiding.

In view of this, the court sentenced Mosharraf Hossain to three months’ imprisonment under the provisions of Section 250(2) of the Code of Criminal Procedure, 1898. In addition, the acquitted AKM Shahidul Islam was ordered to pay 50,000 taka compensation within 30 days of the verdict.

In this regard, Akhtar Hossain, the acting administrative officer of the Chief Judicial Court, said that since the plaintiff’s allegations in the case were proven false, the court ordered the plaintiff to be sentenced to three months’ imprisonment and pay a compensation of Tk 50,000. And since the plaintiff was not present during the hearing, an arrest warrant was ordered against him.
